EMDR Case Intensive Participation Agreement

This Participation Agreement ("Agreement") governs participation in the EMDR Case Intensive ("Consultation") offered through LK Institute. By registering for, purchasing, accessing, attending, or participating in the EMDR Case Intensive, Participant acknowledges that they have read, understood, and agree to the terms outlined below.

 Consultation Description

The EMDR Case Intensive is a small-group professional consultation experience designed to support clinicians in the development of advanced clinical skills, case conceptualization, treatment planning, and application of EMDR therapy. Consultation may include review of case materials, discussion of treatment planning, video review, case conceptualization, EMDR protocol considerations, clinical decision-making, and collaborative problem-solving. The Consultation is educational and consultative in nature and is intended to support professional development and clinical growth.

Consultant Qualifications

Lauren Kiser, PhD, LPC, CEDS-C, is the Founder and Executive Clinical Director of LK Institute. She is a Licensed Professional Counselor, Certified EMDR Therapist, EMDRIA Approved Consultant, EMDRIA Approved Trainer, Certified Eating Disorder Specialist Consultant, and Adult Complex Trauma & Dissociation Specialist. Dr. Kiser has extensive experience treating trauma, dissociation, eating disorders, substance use disorders, anxiety disorders, and other complex clinical presentations across multiple levels of care, including inpatient, residential, partial hospitalization, intensive outpatient, and outpatient settings. She has held numerous clinical leadership positions and has developed specialized treatment programs, professional trainings, and consultation services for mental health professionals. In addition to providing psychotherapy and intensive treatment services, Dr. Kiser provides professional consultation, continuing education, and advanced clinical training to mental health clinicians. Her consultation approach emphasizes thoughtful case conceptualization, strategic treatment planning, clinical decision-making, and practical application of evidence-based interventions for complex cases.

Consultation Format

The EMDR Case Intensive consists of one four-hour live virtual consultation session conducted via Zoom or another approved video conferencing platform. Participation is limited to a maximum of three clinicians per consultation group. Consultation includes advance review of submitted materials by the Consultant and approximately 75 minutes of individualized consultation time for each participant. Consultation time may include case presentation, video review, discussion of treatment planning, case conceptualization, EMDR protocol considerations, and consultation recommendations.

Consultation Fee

The fee for participation in the EMDR Case Intensive is $375.00 per participant. Payment is due at the time of registration unless otherwise specified by LK Institute.

Participant acknowledges that registration reserves one of only three available consultation spaces and includes both the live consultation session and substantial preparation time devoted to advance review of submitted materials. Accordingly, all fees paid for participation in the EMDR Case Intensive are non-refundable except as otherwise expressly stated in this Agreement.

Required Submission Materials

To participate in the Consultation, Participant must submit all required materials no later than seven (7) calendar days prior to the scheduled consultation date.

Required materials include:

  • Completed Case Conceptualization Form
  • Completed Consultee Submission Attestation
  • Video Recording #1 (minimum 20 minutes)
  • Video Recording #2 – Meeting Room Exercise (minimum 20 minutes)

Participant is responsible for ensuring all materials are complete, accurate, and submitted by the deadline. 

Failure to Submit Required Materials

Advance review of submitted materials is a core component of the EMDR Case Intensive and is essential to the individualized consultation experience. Participant understands that the consultation fee includes both the live consultation session and the Consultant's preparation time reviewing submitted materials prior to the session. If required materials are not submitted by the stated deadline, LK Institute reserves the right to decline presentation of the case, limit the scope of consultation provided, reassign consultation time, reschedule participation to a future consultation date subject to availability, or deny participation without refund. Such decisions shall be made at the sole discretion of LK Institute. Participant acknowledges that the consultation fee includes both the live consultation session and the Consultant's preparation time reviewing submitted materials in advance. Because advance review is a fundamental component of the Consultation, failure to timely submit required materials may substantially impair the consultation process and may result in forfeiture of participation rights without refund.

 Scope of Consultation

The EMDR Case Intensive is intended to support professional development and enhance clinical skill through consultation and education. Consultation may include discussion of case conceptualization, treatment planning, EMDR interventions, dissociative and ego state conceptualization, clinical decision-making, and treatment recommendations.

Participant understands that consultation recommendations are based solely upon the information provided and may be limited by incomplete, inaccurate, unavailable, or misunderstood information. Consultation recommendations represent professional opinions and educational guidance based solely upon the information provided by the Participant and should not be interpreted as directives, guarantees, standards of care, legal advice, risk management advice, or clinical mandates. Participant acknowledges that reasonable clinicians may differ in their conceptualizations, treatment recommendations, and clinical opinions.

Consultation Is Not Supervision

Participant understands and agrees that participation in the EMDR Case Intensive does not constitute clinical supervision and does not establish a supervisory relationship. Participation does not create an employer-employee relationship, therapist-client relationship, consultation-retention relationship beyond the scheduled consultation, or any other ongoing professional relationship between the Consultant and the Participant's clients.

Participant remains solely responsible for all professional services provided to their clients.

Professional Responsibility

Participant retains sole responsibility for assessment, diagnosis, treatment planning, informed consent, documentation, risk assessment, crisis intervention, safety planning, ethical decision-making, legal compliance, licensing board compliance, and all clinical decisions related to their clients. Participant agrees to exercise independent professional judgment when considering consultation feedback and acknowledges that implementation of any recommendation is solely their responsibility.

Client Recordings and Confidentiality

Participant represents that appropriate written client authorization has been obtained prior to submission of any recordings and that such authorization is maintained within the client's clinical record. Participant further represents that all submitted materials comply with applicable HIPAA requirements, privacy laws, professional ethical obligations, and licensing board requirements.

Participant acknowledges that clients have been informed that complete de-identification may not be possible due to the nature of audio and video recordings and remains solely responsible for obtaining and maintaining all necessary client authorizations.

Participant further agrees to maintain confidentiality regarding the identities of consultation participants, consultation discussions, consultation recommendations, and any clinical material reviewed during the Consultation.

Storage and Handling of Consultation Materials

Submitted consultation materials will be stored within LK Institute's HIPAA-compliant Google Workspace environment with access limited to individuals reasonably necessary for consultation purposes. LK Institute intends to delete submitted consultation recordings from consultant-controlled systems within seven (7) days following completion of the consultation session.

Participants remain responsible for maintaining their own clinical records in accordance with applicable laws and professional standards.

Virtual Participation Requirements

Participants are expected to attend from a private location appropriate for discussing confidential clinical material and to maintain a stable internet connection throughout the consultation session. Participants are responsible for providing the technology, equipment, internet access, camera, and microphone necessary for participation.

Cameras must remain on throughout the consultation session. Participants are expected to take reasonable steps to prevent unauthorized individuals from viewing or overhearing consultation content.

Confidentiality

Participants acknowledge that confidential clinical material may be discussed during consultation. Participants agree to maintain the confidentiality of all information shared during consultation and to refrain from disclosing information regarding other participants, clients, or consultation content to unauthorized individuals.

While reasonable safeguards are utilized, participants understand that confidentiality cannot be absolutely guaranteed.

Recording Prohibition

Participants may not record, photograph, screenshot, download, reproduce, distribute, transmit, or otherwise capture any portion of the consultation session or consultation materials. Violation of this provision may result in immediate removal from the consultation and exclusion from future LK Institute programs without refund.

Risks, Benefits, and Limitations

Potential benefits of participation include increased clinical knowledge, enhanced case conceptualization, expanded treatment planning options, increased confidence in clinical decision-making, and exposure to alternative professional perspectives.

Participant understands that consultation may involve discussion of challenging clinical material, differing professional opinions, and recommendations that may ultimately prove ineffective, incomplete, inaccurate, or inapplicable to a specific case. No specific outcome, result, certification, professional advancement, client improvement, symptom reduction, treatment success, reduction of liability, or protection from ethical, legal, licensing, or malpractice concerns is guaranteed.

No Guarantee of Outcomes

Participant understands and acknowledges that psychotherapy, EMDR therapy, consultation, education, and professional development activities involve numerous variables beyond the control of the Consultant and LK Institute. Consultation recommendations represent professional opinions and educational guidance based solely upon the information provided by the Participant and should not be interpreted as directives, guarantees, standards of care, legal advice, risk management advice, or clinical mandates.

Accordingly, no representation, warranty, or guarantee is made regarding any particular outcome arising from participation in the Consultation. Neither LK Institute nor the Consultant guarantees the accuracy, effectiveness, appropriateness, completeness, applicability, or success of any consultation recommendation.

Participant further understands that no guarantee is made regarding client outcomes, symptom reduction, treatment effectiveness, treatment completion, risk reduction, professional competence, certification eligibility, consultation credit, licensure outcomes, ethical compliance, legal compliance, malpractice protection, business outcomes, financial outcomes, professional advancement, or any other result arising from participation in the Consultation.

Participant acknowledges that implementation of any consultation recommendation remains solely within the Participant's professional discretion and responsibility and that Participant retains sole responsibility for all professional services provided to their clients.

Cancellation and Refund Policy

Because participation is limited to three clinicians and substantial preparation occurs in advance, all registrations for the EMDR Case Intensive are non-refundable.

No refunds, credits, transfers, or make-up sessions will be provided due to failure to attend, scheduling conflicts, illness, emergencies, technology difficulties, internet connectivity issues, inability to access the virtual platform, incomplete submissions, late submissions, failure to submit required materials by the stated deadline, inability to present a case, dissatisfaction with consultation recommendations, failure to utilize consultation time, or any other circumstance within the Participant's control.

Failure to submit required consultation materials by the stated deadline may result in limitation of consultation services, denial of case presentation, removal from the scheduled consultation, forfeiture of participation rights, or rescheduling at the sole discretion of LK Institute. Such circumstances shall not constitute grounds for a refund. If LK Institute cancels the Consultation, Participant may be offered a refund, credit, or transfer to a future consultation date at the sole discretion of LK Institute.

Limitation of Liability

To the fullest extent permitted by law, Participant agrees that LK Institute, Lauren Kiser, and affiliated employees, contractors, consultants, agents, and representatives shall not be liable for any direct, indirect, incidental, consequential, professional, ethical, legal, regulatory, licensing, business, financial, or reputational damages arising from participation in the Consultation.

Participant acknowledges that all consultation recommendations are educational opinions and that implementation decisions remain solely the responsibility of the Participant.

Participant expressly assumes all risks associated with the implementation or non-implementation of consultation recommendations and agrees that all clinical decisions remain solely the responsibility of the Participant.

LK Institute Policies

Participant acknowledges and agrees that registration for, purchase of, access to, or participation in the EMDR Case Intensive constitutes agreement to comply with all LK Institute Training and Consultation Policies, including any updates thereto. These policies are incorporated into this Agreement by reference and are available at: https://lkinstitute.com/training-policies

Participant is responsible for reviewing all applicable policies prior to participation. Participant acknowledges that failure to comply with LK Institute policies may result in removal from the Consultation, denial of future participation opportunities, forfeiture of consultation credit, or other actions deemed appropriate by LK Institute.

Participant agrees to comply with all LK Institute policies, procedures, participant guides, confidentiality requirements, consultation requirements, and program materials. In the event of a conflict between documents, this Participation Agreement shall govern unless otherwise specified by LK Institute.

Acknowledgment

By registering for, purchasing, accessing, attending, or participating in the EMDR Case Intensive, Participant acknowledges that they have read, understood, and agree to the terms of this Participation Agreement.
